Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Bettereo, including the console at console.bettereo.com, this website and the Bettereo visibility CDN (the “Service”), provided by JSFSI (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms for it, and “you” refers to that organisation.
1. The Service
Bettereo is a visibility CDN. For the domains you configure, it renders your public pages with a headless browser, stores the results as HTML and Markdown, and serves them to search engine crawlers and AI assistants, while forwarding human visitors to your origin. The Service also provides bot analytics, render scheduling, SEO and security reports, AI-assisted visibility suggestions and optional integrations such as Google Search Console.
2. Accounts
- You must be at least 16 years old and able to enter into a binding contract.
- Provide accurate information and keep your sign-in credentials secure. You are responsible for activity under your account and for the users you invite to your tenants.
- Tell us promptly at support@jsfsi.com if you suspect unauthorised access to your account.
3. Acceptable use
You agree that you will not:
- add a domain, origin or sitemap that you do not own or are not authorised to control, or use the Service to render, cache or serve content of a site without its owner’s permission;
- use the Service to serve crawlers content that is deceptive or materially different from what visitors see in a way that violates search engine or AI provider guidelines (for example cloaking to manipulate rankings);
- serve, store or distribute unlawful, infringing, malicious or harmful content, including malware or phishing pages;
- attempt to gain unauthorised access to the Service, other tenants’ data or our infrastructure, or probe, scan or test vulnerabilities without our written permission;
- use the Service to attack, overload or scrape third-party systems, or interfere with the Service’s normal operation;
- resell or sublicense the Service except as we agree in writing;
- use the Service in breach of applicable law, including data protection law.
We may suspend affected domains or accounts to stop a violation or to protect the Service, other customers or third parties, and will tell you when we do unless the law prevents it.
4. Customer content
“Customer content” means your websites’ content, the rendered caches we create from them, your configuration and the data generated about your domains. You keep all rights in your customer content. You grant us a non-exclusive, worldwide licence to fetch, render, store, transform (for example into Markdown), analyse and serve your customer content solely to provide, secure and improve the Service for you.
You are responsible for your customer content and for having the rights and any notices or consents needed for us to process it. When we process personal data on your behalf we act as your processor, as described in our Privacy Policy.
5. Third-party services
The Service relies on and integrates with third-party services such as Google Cloud, Firebase, Cloudflare, Stripe and Google Search Console. Your use of an optional integration is also subject to that provider’s terms. We are not responsible for third-party services or for how search engines and AI assistants index, rank or use your content.
6. Fees and payment
- Paid plans are billed in advance on a recurring basis through Stripe, at the prices shown in the console when you subscribe. Taxes are added where required.
- Subscriptions renew automatically until cancelled. You can cancel at any time; the cancellation takes effect at the end of the current billing period, and fees already paid are not refunded except where required by law.
- If a payment fails we may suspend paid features after giving you notice and a reasonable opportunity to update your payment details.
- We may change prices with at least 30 days’ notice; changes apply from your next billing period.
7. Availability and changes
We work to keep the Service available and reliable, but it is provided without a guaranteed service level unless we agree otherwise in writing. Maintenance, incidents at our providers or events outside our control may cause interruptions. Because Bettereo forwards human visitors to your origin, your site should remain reachable by visitors even if prerendering is unavailable. We may improve, change or discontinue features; we will give reasonable notice before removing a material feature you pay for.
8. Intellectual property
The Service, including its software, design and documentation, belongs to JSFSI and its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. If you send us feedback, we may use it without obligation to you.
9. Disclaimer
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular search ranking, indexing outcome or AI assistant citation.
10. Limitation of liability
To the extent permitted by law, JSFSI will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, traffic, rankings, data or goodwill, arising out of or related to the Service. Our total liability for all claims relating to the Service in any twelve-month period is limited to the amount you paid us for the Service in that period, or EUR 100 if greater. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, wilful misconduct or gross negligence, or for death or personal injury caused by negligence.
11. Indemnity
You will defend and indemnify JSFSI against third-party claims arising from your customer content, from domains you add without authorisation, or from your breach of these Terms.
12. Termination
You may stop using the Service and close your account at any time by contacting us or using the console. We may suspend or terminate your access if you materially breach these Terms and do not cure the breach within a reasonable time after notice, immediately for serious or repeated violations of the acceptable use rules, or if required by law. When your account ends we stop serving your domains and delete your customer content in line with our Privacy Policy. Sections that by their nature should survive termination (including 4, 9, 10, 11 and 13) survive.
13. Governing law and disputes
These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules. The courts of Portugal have exclusive jurisdiction over any dispute, except that if you are a consumer you keep any protection and the right to bring proceedings that the law of your country of residence gives you.
14. General
We may update these Terms. For material changes we will notify you by email or in the console at least 30 days before they take effect; continuing to use the Service after that means you accept the updated Terms. If any provision is held unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and any order or plan you accept in the console, are the entire agreement between you and us about the Service.
